Boxx is operated by Boxx Limited (company number: 09998881), a company registered in England and Wales (“Boxx”, “Boxx+”, “we” or “us”) with registered offices at Mae House, 96 George Lane, South Woodford, E18 1AD.

When you access our platform, app, website, social media, community channels and other websites that we may operate from time to time (“Site”), use the services at the Site (“Services”) or purchase our products (“Products”), these terms (“Terms”) will apply.

By using our Services, you are also agreeing (i) that you have read and understood our Privacy Policy which sets out how we collect, process and use your information; and (ii) to our Medical Disclaimer. Please read these Terms carefully before you start to use our Site and Services. We recommend that you print a copy of these Terms for future reference. If you do not agree to these Terms, you must not use our Site and Services.

1. GENERAL

1.1 These Terms were last updated on 9th May 2025.
1.2 By using our Site or Services, you confirm you are at least 18 years old and agree to be bound by these Terms.
1.3 We reserve the right to update these Terms at any time without notice. Continued use of the Site or Services following such updates constitutes acceptance of the amended Terms.
1.4 We may suspend, restrict or terminate your access or account without notice if we believe you have violated these Terms.

2. MEDICAL NOTICE & DISCLAIMER

2.1 Our Services may include access to fitness, wellbeing, and health-related content, including in-person, live, or on-demand classes and related information (“Classes”). These are provided for educational and entertainment purposes only. They do not constitute medical advice and should not be relied upon as such. Use of the Services is at your own risk.
2.2 Classes can be physically demanding. You are solely responsible for ensuring you are medically fit before participating. By taking part, you confirm that you are healthy and doing so voluntarily.
2.3 To the maximum extent permitted by law, you waive all liability against Boxx and its affiliates, employees, contractors, or agents for any claims arising from your participation in the Classes.

3. BOXX+ APP TERMS

3.1 Account Registration

3.1.1 A valid subscription or free trial is required to access the Services.
3.1.2 You must provide accurate account and payment details and inform us of any changes.
3.1.3 You must protect your login details. Sharing your account or password is prohibited and may lead to charges and/or account termination.

3.2 Subscriptions & Free Trials

3.2.1 Subscriptions may be purchased via an app provider (e.g., Apple, Google Play).
3.2.2 Payment must be made using approved methods. We may validate payment information.
3.2.3 Subscription prices may vary based on type and location and are subject to change.
3.2.4 Currency conversion fees may apply for non-GBP payments.
3.2.5 Free trials are limited to one per user.
3.2.6 If payment details are provided at sign-up, charges will apply automatically at the end of the trial unless cancelled beforehand.

3.3 Renewals, Cancellations & Refunds

3.3.1 Cancel during the free trial to avoid charges.
3.3.2 Once the trial or cancellation period expires, no refunds will be issued unless required by law.
3.3.3 Subscriptions auto-renew unless cancelled. Cancellation will apply to the next billing cycle.
3.3.4 Services remain accessible until the end of the paid period.
3.3.5 Cancelling a subscription via an app provider must be done directly with them.
3.3.6 Refunds (where applicable) may take 5–7 working days.
3.3.7 We do not refund suspended or terminated subscriptions.

3.4 Third-Party Subscriptions

3.4.1 App Providers may manage aspects of your subscription.
3.4.2 Their separate terms will apply.
3.4.3 Boxx cannot cancel or refund subscriptions purchased via an App Provider.

4. BOXXKIDS TERMS

4.1 Eligibility & Parental Responsibility

4.1.1 BoxxKids Activities are intended for children aged 5–17 years.
4.1.2 All children must be registered by a parent or legal guardian ("Parent").
4.1.3 By registering a child, the Parent agrees to be bound by these Terms and is responsible for ensuring the child’s compliance.

4.2 Registration & Booking

4.2.1 All bookings must be made via https://boxxkids.classforkids.io.
4.2.2 Payment must be made at the time of booking, unless otherwise agreed.
4.2.3 Places are subject to availability and are confirmed only upon receipt of payment and confirmation email.
4.2.4 We reserve the right to cancel or reschedule sessions at our discretion.

4.3 Payments, Cancellations & Refunds

4.3.1 Class fees must be paid in advance for term bookings, single sessions, or camps.
4.3.2 Refunds will not be provided for missed sessions unless cancelled by us.

4.4 Behaviour & Safety

4.4.1 We expect all children to behave respectfully and follow instructions from Boxx staff and coaches.
4.4.2 We reserve the right to remove a child from Activities for persistent disruptive or unsafe behaviour. No refund will be given in such cases.
4.4.3 Parents must collect their children promptly at the end of each session.

4.5 Health, Medical Information & Emergencies

4.5.1 Parents must disclose all relevant medical conditions, allergies, or special needs during registration.
4.5.2 BoxxKids staff may administer first aid and seek emergency medical treatment if necessary.
4.5.3 Parents are responsible for ensuring that children are fit to participate in physical activities.

4.6 Data Protection & Communication

4.6.1 We collect and process personal data in accordance with our Privacy Policy.
4.6.2 ClassForKids also operates under its own Privacy Policy, which governs data submitted via their platform.
4.6.3 Parents consent to receiving essential communications regarding bookings, class updates, and child safety.

4.7 Photography & Media Consent

4.7.1 From time to time, we may take photographs or videos during sessions for promotional use.
4.7.2 You will be asked for consent during registration. If you do not wish your child to be photographed or filmed, please ensure you opt out.

4.8 Liability

4.8.1 Boxx takes all reasonable care to ensure children’s safety during Activities. However, we are not liable for accidental injury or loss of personal property unless caused by our negligence.
4.8.2 We are not responsible for children’s belongings. Please label items clearly.

These Terms are governed by the laws of England and Wales. By booking via BoxxKids and ClassForKids, you confirm your agreement with these Terms.

5. BOXX STUDIO TERMS

5.1 Membership

5.1.1 Studio memberships run for a 3-month minimum term and renew monthly thereafter.
5.1.2 Early termination is not permitted during the initial term.
5.1.3 After 3 months, you may cancel by giving 30 days’ notice (see 5.14).

5.2 Booking Studio Classes

5.2.1 Bookings may be made online, via the MindBody App, or in person.
5.2.2 Class cost is displayed at booking.

5.3 Changing or Cancelling Bookings

5.3.1 Cancellations must be made at least 12 hours before the class start.

5.3.2 Late cancellations or no-shows may incur a charge or loss of a class credit. Please refer to our cancellation policy for full details.

5.3.3 You may cancel via our website, the MindBody App or by emailing instudio@boxxldn.com.

5.4 If We Cancel a Class

We will notify you and re-credit any lost Class credit.

5.5 Booking Confirmation

You must receive a booking confirmation before attending a Class.

5.6 Lateness Policy

We operate a strict lateness policy. Entry is not permitted to class if you arrive more than 5 minutes after the Class has started. This is due to health and safety reasons.

5.7 Studio Liability

We are only responsible for foreseeable losses due to our negligence and do not exclude liability for death or injury caused by us.

5.8 Fee Changes

Fees are subject to change after the initial term.

5.9 Promotional Purchases & Offers

5.9.1 Promo credits are genre-specific and non-refundable.
5.9.2 We may withdraw promotions at any time.
5.9.3 Abuse of promotions may result in account suspension or booking cancellations.

5.10 Membership Payments

5.10.1 Monthly payments are made by card or direct debit.
5.10.2 Payment is taken on the same date each month.

5.11 Membership Non-Payment

Access may be restricted for overdue payments. Repeated defaults may result in account termination.

5.12 Membership Cancellation & Freezes

5.12.1 You must give a minimum of 30 days’ notice to cancel your membership.
5.12.2 One freeze allowed per 12 months, not applicable in the first 3 months.

5.13 Class Packs

5.13.1 Valid until clearly stated expiration date.
5.13.2 Not transferable or refundable.
5.13.3 Extensions only granted in exceptional cases.

6. PROMOTIONAL OFFERS AND DISCOUNTS

6.1 Promotions may be subject to separate terms.
6.2 We reserve the right to cancel or modify offers at any time.
6.3 Misuse (e.g., multiple accounts) may lead to account restrictions.

7. WEBSITE & APP TERMS OF USE

7.1 Licence

7.1.1 A personal, non-commercial, limited-use licence is granted.
7.1.2 Reverse engineering, copying or resale of the Site or Services is prohibited.

7.2 Intellectual Property

All content and rights remain with Boxx or its licensors. Unauthorised use is prohibited.

7.3 Availability

7.3.1 Access may be interrupted for maintenance or events outside our control.
7.3.2 We do not guarantee product or service availability.
7.3.3 App updates may be required.

7.4 Accuracy

We aim for accuracy but reserve the right to correct errors or update content without notice.

7.5 Prohibitions

You may not use the Site or Services for illegal, harmful, or abusive purposes, or to infringe on the rights of others.

7.6 External Links

Linked third-party websites are not endorsed or controlled by us.

7.7 User Content & Social Media

7.7.1 You are responsible for all User Content submitted.
7.7.2 By submitting content, you grant us a global, irrevocable licence to use it.
7.7.3 We may use submitted ideas or feedback freely.
7.7.4 We reserve the right to moderate content at our discretion.

8. LIABILITIES & INDEMNITIES

8.1 The Services are provided “as is” and “as available.”
8.2 We exclude all implied warranties to the fullest extent permitted by law.
8.3 We are not liable for events beyond our control.
8.4 We are not liable for any viruses or other technical harm resulting from use of the Site or Services.
8.5 We are not responsible for device damage unless due to our negligence.
8.6 We are not liable for:
8.6.1 Economic losses;
8.6.2 Loss of goodwill or reputation;
8.6.3 Indirect or special losses.
8.7 We do not exclude liability for:
8.7.1 Death or injury caused by negligence;
8.7.2 Fraud;
8.7.3 Anything else unlawful to exclude.
8.8 Any liability is limited to the amount paid for the Services.
8.9 You agree to indemnify Boxx against losses resulting from your breach of these Terms.

9. MISCELLANEOUS

9.1 Personal data is handled in accordance with our [Privacy Policy].
9.2 These Terms do not affect your statutory rights.
9.3 If any part is found unenforceable, the rest remain valid.
9.4 You may not transfer your rights; we may do so without notice.
9.5 Delays or failures to enforce do not waive rights.
9.6 These Terms are governed by the laws of England and Wales, and disputes shall be subject to the jurisdiction of its courts.
